These Terms & Conditions apply to the use of giftoria.com.au and purchases made from Giftoria Pty Ltd, trading as Giftoria (“Giftoria”, “we”, “us” or “our”).
By accessing the website, creating an account or placing an order, you agree to these Terms & Conditions.
1. About Giftoria
Giftoria is an Australian gift retailer based in Melbourne, Victoria.
We offer gifts for her, jewellery, jewellery boxes and keepsakes, ready-made gift sets, Build Your Own Gift Box options and related gift products and services.
Customers may purchase a gift for themselves or arrange for it to be packaged and delivered directly to another person in Australia.
2. Eligibility to Place an Order
You must be at least 18 years old and legally capable of entering into a contract to place an order.
A person under 18 should only use the website and place an order with the permission and involvement of a parent or legal guardian.
You must provide accurate, current and complete information when placing an order.
A customer located outside Australia may place an order for delivery to an eligible Australian address, provided the payment and delivery information can be accepted through our checkout.
3. Website Use
You may use the Giftoria website only for lawful personal or business purchasing purposes.
You must not:
- Use the website for fraudulent or unlawful activity
- Attempt to interfere with website security or operation
- Introduce malicious code, viruses or harmful material
- Access another customer’s account without permission
- Use automated systems to access, scrape or copy the website in breach of our robots.txt, or in a way that places an unreasonable load on the website, except with our written permission.
- Provide false payment, contact or delivery information
- Use Giftoria content in a misleading or unauthorised manner
We may restrict access to the website where reasonably necessary to protect customers, Giftoria or our service providers from fraud, misuse or security threats.
4. Product Information
We take reasonable care to ensure product descriptions, photographs, dimensions, materials, colours and other information are accurate.
However:
- Colours may appear differently because of lighting, photography and screen settings
- Measurements may be approximate
- Handmade, natural, preserved or individually finished products may have minor variations
- Packaging may occasionally be updated without changing the essential nature or value of the product
Minor variations that do not materially affect the product are not considered defects.
Nothing in this section limits your rights where a product is materially different from its description or fails to meet a consumer guarantee under the Australian Consumer Law.
5. Product Availability
All products and gift box components are subject to availability.
Adding a product to the shopping cart does not reserve it. A product may become unavailable before checkout or before an order is fulfilled because of an inventory error, damaged stock or circumstances outside our reasonable control.
If an ordered product becomes unavailable, we will contact you as soon as reasonably possible. We may offer:
- A suitable alternative with your agreement
- A refund for the unavailable item
- Cancellation and a full refund of the affected order
We will not make a material product substitution without your agreement.

6. Build Your Own Gift Box
Giftoria’s Build Your Own Gift Box service allows customers to select eligible products and packaging options to create a personalised gift box.
The minimum number of products, available components, packaging choices and prices displayed on the Build Your Own Gift Box page at the time of checkout apply to the order.
All products and gift box components remain subject to availability. If a selected component becomes unavailable after an order is placed, we will contact you and offer a suitable alternative with your agreement or provide an appropriate refund. Giftoria will not make a material substitution without your consent.
Because products vary in shape, size and presentation, the final placement and arrangement inside the gift box may vary slightly from website photographs. These minor presentation differences do not affect your rights under the Australian Consumer Law.
When you place an order, you are offering to purchase the selected products under these Terms & Conditions. After payment is successfully processed, we will send an electronic order confirmation. The automated order confirmation acknowledges receipt of your order. Your order is accepted when we send a dispatch confirmation, unless we expressly accept it earlier. Please review the confirmation and contact us promptly if any information is incorrect.
7. Orders and Order Acceptance
We may decline or cancel an order before dispatch where reasonably necessary because of:
- Product unavailability or an inventory error
- An obvious pricing or product information error
- A payment failure or chargeback risk
- Suspected fraud or unauthorised activity
- An incomplete or invalid delivery address
- A delivery restriction
- A breach of these Terms & Conditions
If we cancel an order after payment has been taken, we will notify you and provide a full refund for the cancelled item or order. We will not cancel an order for an arbitrary or discriminatory reason.
8. Pricing, Currency and GST
All prices displayed on the Giftoria website are in Australian dollars (AUD).
Prices include GST where applicable unless clearly stated otherwise.
Shipping charges, discounts and the final order total are shown at checkout before payment is completed.
We may change product prices and promotions from time to time. A price change will not retrospectively affect an order that has already been accepted, except where there is an obvious and genuine pricing error.
If an obvious pricing error is identified before dispatch, we will contact you and give you the option to confirm the order at the correct price or receive a full refund.
9. Payments
Orders must be paid using a payment method available at checkout.
Payments are processed by Shopify and authorised third-party payment providers. Your use of a payment service may also be subject to the provider’s terms and privacy policy.
You confirm that:
- You are authorised to use the selected payment method
- The payment and billing information provided is accurate
- Sufficient funds or credit are available to complete the transaction
Giftoria does not generally store complete payment card details.
If a payment is reversed, declined or identified as unauthorised, we may place the order on hold or cancel it and notify you.
10. Promotions and Discount Codes
Promotions and discount codes may be subject to specific conditions stated with the offer, including:
- Start and end dates
- Eligible products
- Minimum purchase amounts
- Usage limits
- Customer eligibility
- Whether the promotion can be combined with another offer
Discounts must be applied before checkout is completed and generally cannot be added retrospectively.
Promotions have no cash value and cannot be exchanged for cash. We may withdraw or correct a promotion where there is a genuine error, fraud or misuse, provided this does not affect an order already accepted or any right that cannot lawfully be excluded.
11. Gift Messages, Gift Bags and Gift Packaging
Where offered, customers may select gift packaging, a gift bag or a complimentary gift message during the ordering process.
Availability and presentation may vary depending on the product, packaging size and options selected at checkout.
You are responsible for checking:
- The recipient’s name
- The delivery address
- The recipient’s telephone number where provided
- The wording and spelling of the gift message
- The selected gift and packaging options
Giftoria may refuse to print or include content that is unlawful, threatening, abusive, discriminatory or otherwise reasonably considered inappropriate.
If you provide personal information about a gift recipient, you confirm that you are authorised or otherwise have a reasonable basis to provide that information for the purpose of preparing and delivering the gift.
12. Shipping and Delivery
Giftoria currently delivers to eligible Australian addresses shown at checkout.
Shipping costs, available services, dispatch information, estimated delivery times, tracking and other delivery conditions are explained in our Shipping & Delivery Policy, which forms part of these Terms & Conditions.
Delivery dates and timeframes are estimates unless expressly stated otherwise. Delays may occur because of courier networks, public holidays, weather, incorrect address information or circumstances outside our reasonable control.
We will take reasonable steps to dispatch orders within the stated timeframe and assist with delayed, lost or damaged deliveries.
You are responsible for providing a complete and accurate delivery address. If an order cannot be delivered because the address supplied was incorrect or incomplete, reasonable redelivery or return-to-sender costs may apply where permitted by law.
Responsibility for the products passes to you or the nominated recipient when the order is delivered to the address provided, collected from an authorised collection point or otherwise delivered in accordance with your authorised delivery instructions.
Nothing in this section limits any responsibility Giftoria has under the Australian Consumer Law.
13. Changing or Cancelling an Order
If you need to change or cancel an order, contact info@giftoria.com.au as soon as possible.
We will try to assist, but we cannot guarantee a change or cancellation after an order has been prepared, personalised, packed or dispatched.
If we can cancel the order before preparation or dispatch, we will provide an appropriate refund to the original payment method.
If an order has already been dispatched, it will be handled under our Returns & Exchanges Policy and applicable consumer law.
14. Returns, Refunds and Australian Consumer Law
Giftoria’s returns process is explained in our Returns & Exchanges Policy, which forms part of these Terms & Conditions.
Giftoria does not generally offer a return, refund or exchange where a customer:
- Changes their mind
- Chooses the wrong product, colour or size
- Finds the product cheaper elsewhere
- No longer wants or needs the product
- Damages or misuses the product after delivery
This change-of-mind position does not affect rights under the Australian Consumer Law.
Giftoria offers a 30-day free returns process for eligible products that arrive faulty, damaged, incorrect, materially different from their description or affected by an inherent product fault not caused by the customer.
The 30-day process is an additional customer service policy. It does not impose a 30-day limit on any right or remedy that may apply under the Australian Consumer Law.
Products sold by Giftoria come with consumer guarantees that cannot be excluded under the Australian Consumer Law. Depending on the circumstances:
- For a major failure, you may be entitled to choose a refund or replacement
- For a minor failure, Giftoria may choose to repair, replace or refund the product within a reasonable time
- You may also be entitled to compensation for reasonably foreseeable loss or damage caused by a failure
Proof of purchase and information reasonably necessary to assess the product may be requested. This may include photographs or video, details of the problem and photographs of damaged external packaging.
Approved refunds will be returned to the original payment method unless another method is required or agreed. Bank and payment-provider processing times may apply.
15. Reviews and Customer Content
If you submit a product review, photograph, message or other content for publication, you confirm that:
- The content reflects your genuine experience or opinion
- You have the right to submit it
- It does not infringe another person’s rights
- It is not unlawful, misleading, abusive, discriminatory or malicious
- It does not contain confidential or unnecessary personal information
You retain ownership of content you create. By submitting content for publication, you give Giftoria a non-exclusive, royalty-free permission to display, reproduce and use that content in connection with the Giftoria website, products and marketing.
We may moderate or remove content where reasonably necessary because it breaches these Terms, is unlawful, contains personal information or is unrelated to the relevant product or service. We will not suppress a genuine review solely because it is negative.
16. Intellectual Property
Unless otherwise stated, the Giftoria website and its original content—including text, photographs, graphics, logos, branding, page designs and product presentation—are owned by or licensed to Giftoria and are protected by applicable intellectual property laws.
You may view and use the website for personal shopping purposes.
You must not reproduce, modify, distribute, sell or commercially use Giftoria content without written permission, except where permitted by law.
Third-party trade marks, payment logos and other third-party content remain the property of their respective owners.
17. Third-Party Services and Links
The Giftoria website may use or link to third-party services, including payment providers, delivery providers, social media platforms and review services.
Giftoria is not responsible for the independent content, availability, security or practices of a third-party website or service.
Your use of a third-party service may be subject to separate terms and privacy policies. This does not limit Giftoria’s responsibility for its own conduct or any responsibility that cannot lawfully be excluded.
18. Privacy
Personal information is handled in accordance with our Privacy Policy.
By providing another person’s details for gift delivery, you confirm that the information is accurate and has been provided lawfully for that purpose.
19. Website Availability
We aim to keep the website accurate, secure and available, but we do not guarantee uninterrupted or error-free access.
We may temporarily suspend access for maintenance, security, updates or circumstances outside our reasonable control.
We will take reasonable steps to correct significant website errors after becoming aware of them.
20. Limitation of Liability
Nothing in these Terms & Conditions excludes, restricts or modifies:
- Any consumer guarantee, right or remedy under the Australian Consumer Law
- Any liability that cannot lawfully be excluded or limited
- Liability arising from fraud, wilful misconduct or any other matter that cannot lawfully be limited
To the maximum extent permitted by law, Giftoria is not responsible for loss or damage that:
- Was not caused by Giftoria’s breach, negligence or wrongful conduct
- Was not reasonably foreseeable
- Was caused by incorrect information supplied by the customer
- Was caused by unlawful or unauthorised use of the website
- Resulted from circumstances outside Giftoria’s reasonable control
Where liability can lawfully be limited, it will be limited only to the extent that is fair, reasonable and permitted under applicable law.
21. Events Outside Our Reasonable Control
Giftoria is not responsible for a delay or failure caused by events outside our reasonable control, such as severe weather, natural disasters, transport disruption, industrial action, network failure, government action or widespread service-provider interruption.
If such an event materially affects an order, we will take reasonable steps to notify you and minimise the effect. Your rights under the Australian Consumer Law continue to apply.
22. Changes to These Terms
We may update these Terms & Conditions when our products, services, business practices or legal obligations change.
Changes will not retrospectively alter an order already accepted unless the change is required by law or agreed with you.
23. Severability
If any part of these Terms & Conditions is found to be invalid, unlawful or unenforceable, that part will be read down or removed to the minimum extent necessary.
The remaining provisions will continue to apply.
24. No Waiver
If Giftoria does not immediately enforce a right under these Terms & Conditions, this does not mean that right has been waived.
A waiver is effective only if clearly communicated in writing and applies only to the specific circumstances for which it is given.
25. Governing Law
These Terms & Conditions are governed by the laws of Victoria, Australia.
You and Giftoria submit to the non-exclusive jurisdiction of the courts of Victoria and any courts that may hear appeals from them.
This section does not prevent a consumer from exercising a right available under applicable Australian law.
